Maybe try:
cvs -d $CVSROOT  -z6 update -d -P

I get this problem too, when the server in CVSROOT/Root doesn't match
$CVSROOT. Forcing cvs to use $CVSROOT via -d helps for me.

(don't ask me how I got in this situation :)
