Now, wait.  Isn't there something about TIOCCONS not being able to grab the
console unless you have read permission on the console?

I have an idea here.

1.  XDM: GiveConsole should be chowning the console to you once you log in to
        the display server.

2.  Console Login.   Once you're logged in, the console belongs to you anyway.

Therefore TIOCCONS should now work.

In fact, isn't this how TIOCCONS works now?
