Your code mistakely doesn't call VOP_ACCESS() when (flags & VWRITE) ==
0).

The code shoould be IMHO like:
	error = VOP_ACCESS(vp, flags, cred, p);
	if (!error && (flags & VWRITE))
		error = vn_writechk(vp);
